VISA CREDIT CARD AGREEMENT


In this Agreement the words you and your mean each and all of those who apply for the card or who sign this Agreement. Card means the VISA Credit Card or supplemental credit device and any duplicates and renewals we issue. Everyone who receives, signs or uses a card issued under this Agreement must be a member of this Credit Union. Account means your VISA Credit Card Line of Credit account with us. We, us and ours mean this Credit Union.

1. Responsibility. If we issue you a card, you agree to repay all debts and the FINANCE CHARGE arising from the use of the card and the card account. For example, you are responsible for charges made by yourself, your spouse and minor children if you give them the card. You are also responsible for charges made by anyone else to whom you give the card until such time as you notify the credit union that such person no longer has authority to use the card. Your obligation to pay the account balance continues even though an agreement, divorce decree or other judgments to which we are not a party may direct you or one of the other persons responsible to pay the account. Any person using the card is jointly responsible with you for charges he or she makes, but if that person signs the card he or she becomes a party to this Agreement and is also jointly responsible for all charges on the account, including yours. You agree not to use your card to effectuate any transaction which is unlawful under applicable law, such as unlawful gambling.

2. Lost Card Notification. If you believe the card has been lost or stolen, you must immediately call the Credit Union during regular business hours at (781) 878-0232 or 800-562-7328 and after regular hours at 800-322-4058. You agree to notify us immediately, orally or in writing of the loss, theft, or unauthorized use of your credit card. You may be liable for the unauthorized use of your credit card. You will not be liable for unauthorized use that occurs after you notify us of the loss, theft, or possible unauthorized use. In any case your liability will not exceed $50 for unauthorized cash advances at ATMs. You will have no liability for unauthorized purchases made with your credit card.

3. Credit Line. If we approve your application, we will establish a self-replenishing Line of Credit for you and notify you of its amount when we issue the card. You agree not to let the principal balance of your account exceed this approved Credit Line. Each payment you make on the account will restore your Credit Line by the amount of the payment which is applied to principal. You may request an increase in your Credit Line only by written application to us, which must be approved by us. We reserve the right to change your Credit Line from time to time, or with good cause, revoke your card and terminate this Agreement. Notice of any change will be given in accordance with applicable law. Good cause includes your failure to comply with this Agreement, or our adverse reevaluation of your credit-worthiness. You may also terminate this Agreement at any time, but termination by either of us does not affect your obligation to pay the account balance. The cards remain our property and you must recover and surrender to us all cards upon our request and upon termination of this Agreement.

4. Credit Information. You authorize us to investigate your credit standing when opening, renewing or reviewing your account, and you authorize us to disclose information regarding your account to credit bureaus and other creditors who inquire of us about your credit standing, to the extent authorized in our By-Laws and applicable law.

5. Monthly Payments. We will mail you a statement every month if your credit card account has a balance or if finance charge is imposed showing your Previous Balance, the current transactions on your account, the remaining credit available under your Credit Line, the New Balances of purchases and cash advances, the Total New Balance, the FINANCE CHARGE due to date, and the Minimum Payment required. Every month you must pay at least the Minimum Payment within 28 days of your statement closing date. If your payment is received more than 15 days after the payment due date, you will be charged a late fee of $25.00. You may, of course, pay more frequently, pay more than the Minimum Payment, or pay the Total New Balance in full, and you will reduce the FINANCE CHARGE by doing so. The Minimum Payment will be either (a) 2% of your Total New Balance, or $15, whichever is greater, or (b) your Total New Balance, if it is less than $15 plus (c) any portion of the Minimum Payment(s) shows on prior statement(s) which remains unpaid. In addition, at any time your Total New Balance exceeds your Credit Line, you must immediately pay the excess upon our demand. We will apply your payments first to previously billed and unpaid FINANCE CHARGE on purchases; then to previously billed and unpaid FINANCE CHARGE on cash advances; then to previously billed purchases, then to cash advances; and then to new purchases, whether or not billed on the monthly statement. However, any payment equal to, or greater than, the Previous Balance of Purchases will be applied first to that balance and any FINANCE CHARGE thereon so as to avoid continuing accrual of FINANCE CHARGE on that amount.

6. Finance Charges shall begin to accrue on Cash Advances as of the date that such Cash Advances are made to you or the first day of the billing cycle in which posted to your account, whichever is later. Finance Charges on Cash Advances will continue to accrue until such Cash Advances are paid in full. Finance Charges shall begin to accrue on Credit Purchases that you make using your card on the date that such Credit Purchase is posted to your account, but only if you elect not to pay the entire New Balance shown on your prior monthly billing statement by the end of the current billing cycle. The grace period can be between 28 and 31 days depending upon the number of days in the billing cycle. If you elect not to pay the entire New Balance shown on your prior monthly statement by the end of the current billing cycle, a finance charge will be imposed on the unpaid balance of Credit Purchases from the statement closing date and on Credit Purchases made during the current billing cycle from the date of posting to your account and will continue to accrue until the closing date of the billing cycle preceding the date on which the entire New Balance is paid in full. Balances on which finance charges accrue are called "balances subject to finance charge."

7. Calculation of Finance Charges. Subject to the rules set forth in paragraph 6 hereof, you shall pay a finance charge on all balances that are subject to finance charge hereunder at the daily periodic rate and ANNUAL PERCENTAGE RATE set forth herein this Agreement. The finance charge for each billing cycle will be computed by multiplying the Average Daily Balance of the balances subject to finance charge for the billing cycle by the daily periodic rate and by the number of days in the billing cycle. The Average Daily Balance is determined by dividing the sum of the closing daily balances subject to finance charge during the billing cycle by the number of days in the cycle. The balance subject to finance charge for any day is determined by adding to the prior day's closing balance subject to finance charge any Cash Advances and Credit Purchases (but only if the previous New Balance was not paid in full by the end of the current billing cycle) posted to your account on such day and subtracting any payments or credits for such day. Finance charges are added to your account by the end of each billing cycle, but such finance charges are never added to the balance upon which finance charges are computed.

8. Other Charges. Your account will be subject to other charges, including, without limitation, a draft retrieval fee of $8.00 for originals and $4.00 for copies. A $10.00 fee is assessed for a replacement card. A $5.00 fee is assessed for a lost/stolen card. If overnight delivery or special handling is requested an additional fee of $75.00 will be assessed. We will assess a $27.00 fee for each returned check and a $5.00 fee per statement copy. A $20.00 fee will be assessed if you exceed your credit limit.

9. Default. You will be in default if you fail to make any Minimum Payment within 28 days after your monthly statement closing date. You will also be in default if your ability to repay us is materially reduced by a change in your employment, an increase in your obligations, bankruptcy or insolvency proceedings involving you, your death or your failure to abide by this Agreement. We have the right to demand immediate payment of your full account balance if you default, subject to our giving you notice. Interest, at the Annual Percentage Rate, shall continue to accrue on all outstanding balances until the date of payment in full.

10. Collection. You agree to pay any costs of collecting amounts owed on your account. Whenever the Credit Union refers your account to an attorney, you agree to pay attorneys' fees and all costs and court fees.

11. Using the Card. To make a purchase or cash advance, there are two alternative procedures to be followed. One is for you to present the card to a participating VISA plan merchant, to us or to another financial institution and sign the sales or cash advance draft which will be imprinted with your card. The other is to complete the transaction by using your Personal Identification Number (PIN) in conjunction with the card in an Automated Teller Machine or other type of electronic terminal that provides access to the VISA system. The monthly statement will identify the merchant, electronic terminal or financial institution at which transactions were made, but sales, cash advance, credit or other slips cannot be returned with the statement. You must retain the copy of such slips furnished at the time of the transaction in order to verify the monthly statement.

12. Returns and Adjustments. Merchants and others who honor the card may give credit for returns or adjustments, and they will do so by sending us a credit slip which we will post to your account. If your credits and payments exceed what you owe us, we will hold and apply this credit balance against further purchases and cash advances, or if it is $1 or more, refund it on your written request or automatically after 6 months.

13. Foreign Transactions. Purchases, cash withdrawals and cash advances made in foreign currencies will be debited from your account in U.S. dollars. The exchange rate between the transaction currency and the billing currency used for processing international transactions is a rate selected by VISA from a range of rates available in wholesale currency markets for the applicable central processing date, which rate may vary from the rate VISA itself receives, or the government mandated rate in effect for the applicable central processing date. The exchange rate used on the processing date may differ from the rate that would have been used on the purchase date or the cardholder statement posting date.

Effective April 1, 2008 a fee of 1% of the transaction amount posted to your account will be imposed on all foreign transactions made in a foreign currency, including purchases, cash withdrawals, or cash advances. A fee of 0.8% of the transaction amount posted to your account will be imposed on all foreign transactions made in U.S. dollars, including purchases, cash withdrawals, or cash advances. A foreign transaction is any transaction that you complete or a merchant completes on your card and the cardholder's country is different than the merchant country excluding Puerto Rico, or the US Virgin Islands. This foreign fee will be posted as a seperate transaction on your statement.

A devaluation of the US dollar against the foreign currency in which the transaction was made will result in higher then expected dollar amount charged to your account. This currency differential, along with any transaction fee for the foreign exchange, could result in your account becoming overdrawn.

Use of your card outside the United States of America may be subject to certain limitations. If you are traveling outside the United States, you understand that you may contact the Credit Union for information concerning such limitations in various countries.


14. Plan Merchant Disputes. We are not responsible for the refusal of any plan merchant or financial institution to honor your card. We are subject to claims and defenses (other than tort claims) arising out of goods or services you purchase with the card only if you have made a good faith attempt, but have been unable to obtain satisfaction from the plan merchant, and (a) your purchase was made in response to an advertisement we sent or participated in sending you; or (b) your purchase cost more than $50 and was made from a plan merchant in your home state or within 100 miles of your home. Any other disputes you must resolve directly with the plan merchant.

15. Effect of Agreement. This Agreement is the contract which applies to all transactions on your account even though the sales, cash advance, credit or other slips you sign or receive may contain different terms. We may amend this Agreement from time to time including the rate of finance charge or minimum payment provisions by sending you the advance written notice required by law. Your use of the card thereafter will indicate your agreement to the amendments. To the extent the law permits, and we indicate in our notice, amendments will apply to your existing account balance as well as to future transactions.

16. The Credit Union may amend the terms and conditions set forth in this agreement, provided that such amendment shall not be effective unless written notice of such amendment is mailed or delivered to you at least one billing cycle, but not less than 30 days, prior to the effective date of the change.

17. Copy Received. You acknowledge receipt of a copy of this Agreement.

18. No Waiver. The Credit Union can delay enforcing any of its rights any number of times without losing them.

19. Statements and Notices. Statements and notices will be mailed to you at the most recent address you have given the Credit Union. Notice sent to any one of you will be considered notice to all.

20. Convenience Checks. From time to time the Credit Union may provide you with access to your credit line by use of convenience checks. Convenience checks are processed as cash advances and are subject to credit availability. Convenience checks are always subject to finance charges from the date they are posted to your account.

21. Preventing Payment on Convenience Checks. If you wish to prevent payment of a Convenience Check, we may be able to help. Call us at (781) 878-0232 or 800-562-7328. Be prepared to describe the Convenience Check with certainty including the specific date, exact amount of the Convenience Check and the Check number. It is important that all items be correct. If any single item is incorrect, we may not be able to prevent payment of the Check. You must confirm the request in writing within ten (10) days of your telephone call. A written request will expire after a period of six (6) months but may be renewed upon written request. If the written request expires, the Convenience Check may be paid if presented.

If you follow these instructions and we receive your request in time to afford us reasonable opportunity to act, we may be able to prevent payment of the Convenience Check. You agree to hold us harmless and indemnify us for any losses, expenses and costs, including attorney fees incurred by us, for preventing payment of any Convenience Check.

22. Stop Payment Fee. If you ask us to Stop Payment on a Convenience Check you have written, you will be charged the current Stop Payment Fee of $26.00 which will be added as a purchase to your balance.

YOUR BILLING RIGHTS

This notice contains important information about your rights and our responsibilities under the Fair Credit Billing Act.

Notify us In Case of Errors or Questions About Your Bill
If you think your bill is wrong, or if you need more information about a transaction on your bill, write us on a separate sheet at the address listed on your bill. Write to us as soon as possible. We must hear from you no later than 60 days after we sent you the first bill on which the error or problem appeared. You can telephone us, but doing so will not preserve your rights. In your letter, give us the following information:
  • Your name and account number
  • The dollar amount of the suspected error
  • Describe the error and explain, if you can, why you believe there is an error. If you need more information, describe the item you are not sure about.
If you have authorized us to pay your credit card automatically from your savings or checking account, you can stop the payment on any amount you think is wrong. To stop the payment, your letter must reach us three business days before the automatic payment is scheduled to occur.

Your Rights and Our Responsibilities
After We Receive Your Written Notice
We must acknowledge your letter in 30 days, unless we have corrected the error by then. Within 90 days, we must either correct the error or explain why we believe the bill was correct.

After we receive your letter, we cannot try to collect any amount you question, or report you as delinquent. We can continue to bill you for the amount you question, including finance charges, and we can apply an unpaid amount against your credit limit. You do not have to pay any questioned amount while we are investigating, but you are still obligated to pay the parts that are not in question.

If we find that we made a mistake on your bill, you will not have to pay any finance charges related to any questioned amount. If we didn't make a mistake, you may have to pay finance charges, and you will have to make up any missed payments on the questioned amount. In either case, we will send you a statement of the amount you owe and the date that it is due.

If you fail to pay the amount that we think you owe, we may report you as delinquent. However, if our explanation does not satisfy you and you write to us within ten days telling us that you still refuse to pay, we must tell anyone we report you to that you have a question about your bill. We must also tell you the name of anyone we reported you to. We must tell anyone we report you to that the matter has been settled between us when it is. If we don't follow these rules, we can't collect the first $50 of the questioned amount, even if your bill was correct.

Special Rules for Credit Card Purchases
If you have a problem with the quality of property or services that you purchased with a credit card, and you have tried in good faith to correct the problem with the merchant, you may have the right not to pay the remaining amount due on the property or services. There are two limitations on this right:
  • (a) You must have made the purchase in your home state or, if not within your home state, within 100 miles of your current mailing address; and
  • (b) The purchase price must have been more than $50.
These limitations do not apply if we own or operate the merchant, or if we mailed you the advertisement for the property or services.
